Please read the below Terms and Conditions BEFORE filling out the form. Closing the form midway to read the Terms and Conditions may lead to a loss of answers and having to start the form again.
Pose And Click Photo Booth cannot be held liable for any errors, omissions, etc. Therefore, we request that answers on the form are double checked before submitting.
TERMS AND CONDITIONS
The Supplier
Raj Lall trading as Pose and Click Photo Booth (from now on known as the “the Supplier”)
The Customer
The customer booking the Supplier for their event (from now on known as “the Hirer”)
The following contract and its terms comprise an agreement between the Supplier and the Hirer for the hire of the Photo Booth.
This written contract sets out the full intentions of the parties made between the Hirer and Supplier.
Access, Space and Power Requirements
The Hirer will need to inform the Supplier if access to the venue is restricted by stairs, etc.
The Hirer will need to inform the Supplier if access to the venue is more than 100 metres from the car park. The Hirer will need to arrange with the venue an access point within close proximity of the venue.
Access to the venue is required 1 hour before the hire time starts and 1 hour after the hire time expires, the Hirer is not charged for this time. If access cannot be obtained prior to the hire time, the setting up of the Photo Booth will be undertaken during the hire time and service time.
The Hirer will arrange for an appropriate and safe operating space to be made available for the Photo Booth at the event venue. The space required is a length of 3 metres and a width of 2 metres, with a height requirement of 2 metres.
The area will need to be indoors and level. Setup in a marquee is possible, but it must be safe to operate, rain proof and on safe ground such as boarding and carpet. Ground such as gravel, mud, grass, etc. will not be acceptable. The Supplier will have the right to leave in this case, and no refund will be considered.
The Hirer will provide a mains electricity supply comprising a two 13amp socket located within the space designated by the Hirer for the Photo Booth.
Service Period
The service period of the Photo Booth is at the agreed time. If the event is running late or early, this will reduce the Hirer’s actual service time and usage period. The Supplier agrees to provide a Photo Booth operational and available for use for a minimum of 85% of the agreed service period. The remainder of the time is to permit maintenance of the Photo Booth.
Payment
A non-returnable deposit of £150.00 of the agreed rental charge is required to secure a reservation for the Photo Booth, the balance of the agreed rental charge is due 28 days before the Hirer’s event.
If payment is not received 28 days before the event, the booking may be cancelled by the Supplier without further notice and the deposit will not be refunded.
If the Hirer books the Photo Booth within a period of 28 days before the event, the full agreed balance will be payable immediately. If the event is then cancelled by, but not limited to, the Hirer, there will be no refund.
If the Hirer requests extra time during the event, then that will be payable immediately to the Supplier at the event at the rate of £50.00 per 30 minutes. Payment of all additional rental charges must be made by the Hirer before any additional period commences. This will be subject to availability.
Date changes & cancellations
One request to change the agreed date of the rental of the Photo Booth is permitted and must be made in writing before 29 days of the event. Change of date will be allowed but will be subject to availability. If the date is not available, the deposit will not be returnable, and the Hirer will not be liable for the full agreed fee if a date change is requested 29 days before the event. Further requests to change the hire date is at the discretion of the Supplier.
A request to change the agreed date of the rental of the Photo Booth within 28 days of the event is permitted but will be subject to availability. If the date is not available, the full charge of the hire will not be returnable.
If the Hirer cancels an agreed rental of the Photo Booth up to 29 days before the rental date the deposit paid will be forfeit.
If the Hirer cancels the Photo Booth within 28 days of the event, the Hirer will be liable for the agreed cost of the hire on an indemnity basis and any legal costs incurred on an indemnity basis.
In relation to refunds, date changes and cancellations, the date is calculated from when the Hirer originally entered into an agreement to hire the Photo Booth and the original hire date. Revised dates do not restart the date calculation period.
Loss or damage to provider’s equipment
The Hirer will be responsible for the duration of the hire (including set up time and dismantling time) to provide the Supplier with a safe working environment free from any verbal or physical abuse. The Hirer will be completely responsible for any loss or damage to the Supplier’s equipment caused by any misuse of the equipment by the Hirer, their guests or anyone associated to the Hirer. The Supplier will have the right to leave the event, and in such an occurrence, no refund will be considered by the Supplier.
The Hirer shall be responsible for any loss or damage to the Supplier’s equipment caused by, but not limited to, theft, flood, fire, deliberate and accidental damage.
In the event the Supplier feels unsafe, threatened, etc. the Supplier may inform the Hirer of the Supplier’s concerns depending on safety and timing issues and the Supplier will have the right to leave the venue. In such an event, no refund will be considered.
Indemnification
The Hirer is to pay all venue fees. The Supplier will not pay any venue fees.
The Hirer agrees to indemnify the Supplier against any and all liability related to the Hirer’s event and use of the Supplier’s equipment. The Hirer will indemnify the Supplier against any and all liability associated with the use of any pictures taken at the Hirer’s event by the Supplier.
The Hirer indemnifies and agrees to, and understands that they must inform their guests using the Photo Booth at the event that the Supplier has the right and permission to copyright and to reproduce any photographic pictures for, but not limited to, art, promotion, advertising.
If any of the terms and conditions are deemed to be unlawful by a Court of Law, void, or for any reason unenforceable under contract law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof.
The Supplier is not responsible for any consequential damages or lost opportunities caused to Hirer, the Hirer’s guests or associates due to the hiring of the Photo Booth.
Unforeseen circumstances
In the event the Supplier is unable to attend the Hirer’s event due to, but limited to, weather conditions, acts of god, road closures, vehicle breakdown, unexpected events, etc. the Supplier will not pay any compensation but will consider a refund of the full hire charge if requested by the Hirer in writing within 30 days after the event.
In the event of a power failure at the venue, the full hire rate will still remain payable and no refund will be offered.
In the event of equipment failure, the Supplier will attempt their utmost to rectify the issue and will inform the Hirer of Supplier’s intentions. In the unlikely event that the photographic printer fails at the time of the event, the Supplier will provide the photographs on either social media, a website, USB stick or a full set of prints to the Hirer.
